CLARIFICATION TEXT REGARDING THE PROCESSING OF PERSONAL DATA

As Dinamik360 Yazılım A.Ş. (“DinamikCrm”), we work to protect the privacy of our members who use our site to ensure that our users can benefit from our services safely and completely. This Clarification Text has been prepared to inform you about the personal data processed through the website operated by DinamikCrm at www.dinamikcrm.com. We are extremely sensitive about the security of your personal data.

In this regard, we place great importance on processing and preserving all kinds of personal data belonging to our members in the best possible way and with due diligence. Being aware of this responsibility, we process your personal data within the framework specified below in accordance with the Law No. 6698 on the Protection of Personal Data (“Law”) and related legislation to protect the privacy of personal life, fundamental rights, and freedoms.

DinamikCrm processes your personal data as the “Data Controller” defined in Article 3 of the Law. Within the framework of the regulations brought by the Law No. 6698 on the Protection of Personal Data (“KVKK”), we would like to inform our valued customers as the Data Controller on how personal data is recorded, processed, and the purpose of processing.

2. Collection, Processing, and Processing Tools of Personal Data

Your personal data will be processed in accordance with the personal data processing conditions and purposes specified in Articles 5 and 6 of KVKK, in a lawful, ethical, and honest manner, correctly, and by updating it with the principles of legality and legitimacy.

Your special category personal data and general personal data are processed proportionately by DinamikCrm for the following purposes:

  • To carry out the activities conducted by our company,
  • To perform the necessary work to benefit you from the products and services offered by our company and to conduct related business processes,
  • To determine and implement our company’s commercial and business strategies,
  • To plan and manage the activities of our company, to continue membership procedures if a membership application is made and to keep members informed of updates and innovations related to processes, to ensure that current news reaches members if they subscribe to newsletters,
  • To customize and promote products and services offered by our company according to the likes, usage habits, and needs of the relevant persons, and to carry out membership, sales, advertising, communication, promotion, marketing, and store card transactions and related notifications and applications,
  • To plan and carry out special sales and marketing activities for our customers,
  • To carry out and execute customer services and relationships,
  • To ensure the legal and commercial security of the products and services offered by our company and the third parties in business relationships with our company,
  • To conduct administrative operations for communication carried out by our company,
  • To ensure the physical security and supervision of our company locations,
  • To manage customer evaluation/complaint management processes, reputation research processes, event management, legal compliance process, audits, financial affairs, etc.,
  • To follow legal processes and establish, use, and protect the rights arising from legislation,
  • To plan and execute after-sales support services, customer satisfaction, corporate communication activities, customer relations, and the management of customer requests and complaints,
  • To ensure that company activities are carried out in accordance with company procedures or relevant legislation,
  • To plan or execute business continuity activities,
  • To plan, audit, and execute corporate sustainability, corporate governance, strategic planning, and information security processes; to execute works and manage relationships conducted with our business partners, dealers, or suppliers.

For the above-mentioned purposes, your personal data may be processed automatically or non-automatically by our company’s units, branches, stores, offices, website, call center, social media channels, mobile applications, and similar means verbally, in writing, or electronically, provided that it is not exceeded for the maximum legal periods. It may be recorded, stored, preserved, processed, made available, used, updated, changed, merged, reorganized, classified, disclosed, shared, transferred, transferred abroad, and subjected to other processes provided for in the personal data legislation to the extent permitted by the legislation.

In accordance with the Law, DinamikCrm, as the Data Controller, may obtain, collect, record, store, preserve, update, change, reorganize, use, disclose, transfer, share, anonymize, and process your personal data for the duration required by the purposes stated above and for the period required by the purposes stated above, and may process it in the ways listed in the Law, provided that it is limited to the purposes and duration required by the purposes stated above.

When the purpose of processing your personal data ceases to exist, all your processed personal data may be anonymized and used or destroyed in a way that cannot be accessed, provided that necessary and reasonable information security measures are taken.

3. Transfer of Personal Data

Your personal data, within the framework of the purposes stated above and in accordance with the fundamental principles stipulated by the KVKK, will be shared with DinamikCrm employees, shareholders, managers, business partners, subcontractors, human resources, legal, financial, and tax advisors, and auditors, company consultants, attorneys, official supervisory and regulatory authorities within the framework of the legislation and not limited to these, only if necessary, to domestic or foreign third parties and only in proportion to the processing purpose, to the extent permitted by the legislation (in accordance with Articles 8 and 9 of the Law).

Your personal data may be transferred electronically or physically. During this transfer, all security measures are taken to ensure data security, and your personal data is not allowed to fall into unauthorized persons’ hands.

4. Method and Legal Reason for Collecting Personal Data

Your personal data is obtained and processed through any verbal, written, or electronic medium, including but not limited to the methods specified in Article 2 of this clarification text, limited to the purposes specified in Article 2, and in order to carry out DinamikCrm’s activities, to provide related products and services within the legal framework and to fully and accurately fulfill our company’s contractual and legal obligations.

Your personal data is collected directly from you, our customer, through various official institutions or directly or indirectly from our affiliates, subsidiaries, controlling shareholders, or real or legal third parties from whom we receive or provide services, through our headquarters, call center, websites, business partners, online transactions, seller and/or dealer network, and other distribution channels by any verbal, written, or electronic means.

Your personal data is collected through the forms you have filled out with your explicit consent to date, when logging into our websites, and through forms you have filled out with your explicit consent when contacting us, and will continue to be collected in this way. In this context, the processing of personal data by DinamikCrm is carried out with explicit consent given within the scope of Article 6 of the Law and in any case in accordance with the conditions and purposes of personal data processing specified in Articles 5 and 6 of the Law.

5. Your Rights as a Personal Data Owner Under the Law

Regarding your processed personal data, in accordance with the legislation:

  • To learn whether personal data is being processed or not,
  • To request information if personal data has been processed,
  • To learn the purpose of processing personal data and whether they are used in accordance with their purpose,
  • To know the third parties to whom personal data is transferred domestically or abroad,
  • If personal data is incomplete or incorrectly processed, to request their correction and to request the notification of the transaction made within this scope to the third parties to whom personal data has been transferred,
  • To request the deletion or destruction of personal data in the event that the reasons for processing have disappeared, even though it has been processed in accordance with the provisions of the KVKK and other relevant laws, and to request the notification of the transaction made within this scope to the third parties to whom personal data has been transferred,
  • To object to the occurrence of a result against the person himself/herself by analyzing the processed data exclusively through automated systems,
  • To claim compensation for the damage arising from the unlawful processing of personal data.

You can submit your requests regarding your rights under the Law in accordance with Article 13, paragraph 1 of the KVKK, in writing or by using other methods determined by the Personal Data Protection Board (registered electronic mail (“KEP”) address, secure electronic signature, mobile signature or using

the electronic mail address previously notified to our Company by the relevant person and registered in the data controller’s system, or through a software or application developed for the application purpose).

When you want to use your above-mentioned rights, you can submit your request to us in writing or through other methods determined by the Personal Data Protection Board.

DinamikCrm responds to personal data owners who wish to use their rights within the limits specified in the Law, again in the manner specified in the Law, within a maximum of thirty (30) days. In order for third parties to make a request on behalf of personal data owners, there must be a special power of attorney issued by the personal data owner through a notary public on behalf of the person who will make the request. As a rule, personal data owner requests are processed free of charge, but if a fee schedule is provided by the Personal Data Protection Board, the fee will be charged based on this schedule.

DinamikCrm may request information from the relevant person to determine whether the applicant is the personal data owner, and may ask questions to the personal data owner to clarify the issues specified in the request.
